These Rental Terms and Conditions, along with the Rental Agreement signed at the time of pick-up, form the contract between Unicorn Rent A Car Ltd and you, the Renter, for the rental of the vehicle specified in the Rental Agreement.
1) Definitions
- Rental Agreement: The document signed at the time of vehicle pick-up, detailing rental specifics, rates, and insurance coverage.
- Vehicle: The car, van, or other motor vehicle described in the Rental Agreement, including all parts, tools, accessories, and documents.
- Rental Period: The duration of the rental from pick-up to return.
2) Booking Your Rental
- Reservation: Book via our https://unicornrentacar.co.ke/, phone, or email. Confirmation is given upon receipt of a booking confirmation.
- Information Provided: Ensure accurate details such as name, contact info, and age.
- Vehicle Category: If your confirmed category is unavailable, a similar or higher category will be provided at no extra cost.
3) What Is Included in the Price?
- Vehicle rental for the specified period.
- Unlimited mileage (if applicable).
- Third-Party Liability Insurance.
- Collision Damage Waiver (CDW) with an excess amount.
- Theft Protection (TP) with an excess amount.
- Local taxes (e.g., VAT).
- Roadside assistance for mechanical breakdowns.
4) What Is Not Included in the Price?
- Fuel.
- Security Deposit.
- Excess/deductible amounts for CDW and TP.
- Optional insurance waivers.
- Additional Driver fees.
- Young or senior driver surcharges.
- Optional extras (e.g., child seats, GPS).
- One-way rental fees.
- Out-of-hours pick-up/return fees.
- Cross-border fees.
- Traffic or parking violation penalties.
- Refuelling charges.
- Costs for lost keys or vehicle documents.
5) Pick-Up Requirements
- Valid Driving License: Held for at least [e.g., 2] years. Non-English licenses require an IDP.
- Valid Identification: National ID (Kenyan residents) or passport (non-residents).
- Booking Confirmation: Your Unicorn booking confirmation.
- Valid Credit Card: Required for security deposit and charges. Debit cards may have restrictions.
- Age Requirements: Renters must generally be between [e.g., 23 and 70] years old.
6) Security Deposit
- A security deposit will be blocked or charged on the renter's credit card.
- Covers excess, potential damages, fuel discrepancies, fines, and other charges.
- Refunded after return if the vehicle is in good condition and all charges are settled.
7) Insurance Coverage
- Third-Party Liability: Covers third-party injuries and property damage.
- Collision Damage Waiver (CDW): Reduces liability for vehicle bodywork damage, subject to an excess.
- Theft Protection (TP): Reduces liability in case of theft, subject to an excess.
- Excess Amount: The maximum amount you must pay for damage or theft.
- Optional Insurance Waivers: Additional coverage options such as Super CDW and windscreen, tyres, undercarriage protection.
- Insurance Exclusions: Insurance does not cover negligence, unauthorised driving, wrong fuel usage, or personal belongings.
- Accident/Theft Procedure: Report incidents to Unicorn and police immediately and obtain the necessary documents.
8) Fuel Policy
- Full to Full: The vehicle is provided with a full tank and must be returned full.
- Alternative Policies: May include pre-purchased fuel or same-to-same options.
- Refuelling Charge: Charges apply if returned with less fuel than received.
9) Mileage Policy
- Rentals typically include unlimited mileage within specified geographical limits.
- If mileage restrictions apply, excess mileage will be charged at a per-kilometre rate.
10) Cross-Border Travel & Geographical Restrictions
- Taking the vehicle outside Kenya is generally not permitted.
- Prior written authorisation is required for cross-border travel with additional fees and documentation.
- Driving in restricted areas within Kenya may require approval or be prohibited.
11) Breakdown, Accidents, and Repairs
- Contact Unicorn's 24/7 roadside assistance immediately in case of breakdown.
- Follow Section 7.g procedure for accidents to maintain insurance validity.
- Unicorn covers normal mechanical failure repairs, but misuse-related costs may be charged.
12) Additional Drivers
- Additional drivers must be registered at pick-up and meet age/licence requirements.
- A daily/per rental fee applies for additional drivers.
- The main renter is responsible for the actions of any additional drivers.
13) Optional Extras
- Optional extras such as child seats, GPS, chauffeur services are available on request.
- Charges apply for lost or damaged optional extras.
14) Vehicle Return
- Vehicle must be returned at the agreed location, date, and time.
- Late returns may incur additional charges; early returns may not be refunded.
- Out-of-hours returns require special procedures.
15) Cancellations, Amendments, and No-Shows
- Cancellations made within a specified timeframe may be subject to charges.
- No-shows may incur fees up to the full rental cost.
- Unicorn may cancel bookings due to unforeseen circumstances and offer refunds.
16) Traffic Violations, Fines, and Penalties
- Renters are responsible for traffic violations, fines, and toll charges.
- Unicorn may charge an administrative fee for processing fines.
17) Liability
- Unicorn is liable for foreseeable losses caused by its negligence but not indirect or consequential losses.
- Renters are liable for damage or costs due to breach of terms or misconduct.
18) Chauffeur Services
- Chauffeur service terms will be outlined separately.
- Drivers must follow all laws and Unicorn policies.
19) Data Protection and Privacy
We process personal data as per our Privacy Policy: View Policy.
20) Complaints
If you have complaints, contact our customer service within 28 days.
21) Governing Law and Jurisdiction
These Terms are governed by Kenyan law, and disputes fall under Kenyan jurisdiction.
22) Modifications to Terms
Unicorn may update these Terms periodically, with significant changes notified.
23) General Provisions
- These Terms constitute the full agreement.
- No waivers shall be considered permanent.
